Prosecution under the Regulatory Reform (Fire Safety) Order 2005

Nottingham Fire and Rescue Service successfully prosecuted LFF Ltd under the Regulatory Reform (Fire Safety) Order 2005 for failing to have a fire detection warning system and for failing to ensure that the upper floor escape routes were adequately protected from smoke and fire. The Company suffered a fine, victim surcharge and had to pay full court costs.

The magistrates emphasised that safety always takes priority over financial considerations.

Remember, the authorities also have the power to issue Enforcement and Prohibition notices limiting the use of premises until safety improvements have been carried out.
